Terms of Service

1. Acceptance of Terms

By accessing or using TalkCut ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

TalkCut is an AI-powered video creation platform that provides an infinite canvas for creative exploration, a precision timeline for editorial control, and AI generation capabilities through third-party model providers. The Service includes workspace memory, media upload, AI generation, and project export features.

3. Account Registration

To use TalkCut, you must create an account using a supported authentication provider (e.g., Google). You are responsible for maintaining the security of your account and for all activities that occur under your account.

4. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Infringe on intellectual property rights of others
  • Attempt to reverse-engineer, decompile, or extract the source code of the Service
  • Use automated systems or bots to access the Service without authorization
  • Interfere with or disrupt the Service or its infrastructure
  • Resell access to the Service without written permission

5. Content Ownership

Your Content

You retain ownership of all content you upload to TalkCut, including images, videos, and other media. By uploading content, you grant TalkCut a limited license to process, store, and display your content as necessary to provide the Service.

AI-Generated Content

Content generated through TalkCut's AI features is subject to the terms of the underlying AI model providers. TalkCut does not claim ownership of AI-generated outputs. You are responsible for ensuring your use of AI-generated content complies with applicable laws and the model providers' terms.

Workspace Memory

Creative preferences stored in Workspace Memory (brand guidelines, style profiles, etc.) remain your property. This data is used solely to personalize the Service for your workspace.

6. Third-Party Services

TalkCut integrates with third-party AI model providers (including Fal AI, Google Veo, ElevenLabs, and xAI) to deliver generation capabilities. Your use of these features is also subject to the respective providers' terms of service. TalkCut is not responsible for the availability, accuracy, or output of third-party AI models.

7. Subscription & Payment

Certain features of TalkCut require a paid subscription. Pricing, features, and billing terms are described on our pricing page. We reserve the right to modify pricing with 30 days' notice to existing subscribers.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime.

9. Limitation of Liability

To the maximum extent permitted by law, TalkCut shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after account deletion to allow for recovery, after which it will be permanently deleted.

11. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or a notice on the Service. Continued use after changes take effect constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
